Personal Data Protection: General information for data subjects

1. Legal Basis:

PRODUCTOO s.r.o., based at Nad Zámkem 1072, 674 01 Třebíč, ID no.: 03090141, File no.: C 83255 kept at the Regional Court in Brno, undertakes to process the provided or obtained personal data in accordance with the legislation, in particular with the Regulation of the European Parliament and the Council (EU) no. 2016/679 of 27 April 2016 on the protection of individuals with regard of the processing of personal data and on the free movement od such data, and repealing Directive 95/46/EC.

2. Personal Data Manager:

The manager is PRODUCTOO s.r.o., based at Nad Zámkem 1072, 674 01 Třebíč, ID no.: 03090141, File no.: C 83255 kept at the Regional Court in Brno. The data manager can be contacted in writing at the Company’s registered office, by phone at +420 226 218 298 and by e-mail at office@productoo.com.

3. Legal Basis for the Personal Data Processing:

  • Contract with a business partner (written or oral), employment or other contract of a similar nature,
  • the data subject is obliged to provide personal data the processing of which is essential to establish the contractual relationship and for its fulfilment,
  • in a number of cases, personal data providing and processing of is based on legal duties of the manager (e.g. accounting and payroll duties), and/or
  • in some cases, personal data processing is necessary for the purposes of the legitimate interests of the manager or a third party (e.g. possibility of dispute or its management with the data subject or a third person).

4. Personal Data Recipients:

  • public authorities (e.g. administrative authorities),
  • computer network administrator,
  • accountants,
  • other recipients according to the needs and/or instructions of the data subject or business partners.

(some of these recipients, such as a computer network administrator or accountants, are or may be so-called “personal data processors”)

5. Time period for Personal Data Processing:

The company processes personal data only for the time necessary for the relevant processing purposes. This time is always the longest time that may be considered in the case in question (e.g. time of duration of the contractual relationship plus the limitation period for the commencement of the dispute reasonably extended, in the event of the commencement of the dispute during its duration including the duration of the appeal proceedings, including extraordinary appeals, and time according to special regulations).

6. Rights of the Data Subject (subjects whose data are being processed):

  • the right to transparent information, communications and procedures to exercise their rights in a comprehensible and easily accessible way,
  • the right to information on processed personal data, obtained from the data subject or in some other way than from the data subject,
  • the right to access to personal data – the data subject has the right to obtain from the manager the information as to whether and to what extent and in what manner his/her data are processed,
  • the right to correction – inaccurate or incomplete personal data are corrected or completed based on a request from the data subject, based on information from other sources, being updated on a regular basis,
  • the right to erasure (the right to be forgotten) – the data subject has the right to dispose of his data at his own request unless the exclusion of that right,
  • the right to have the processing restricted – the data subject has the right to have the processing of his or her data restricted at his/her request unless the exclusion of that right,
  • the right to be informed about the personal data correction or erasure or about processing restrictions,
  • the right to data portability – the company does not process personal data in an automated manner and therefore the company cannot even be required to ensure such a right,,
  • the right to object (against the processing of personal data),
  • the right not to be the subject of a decision based solely on automated processing, including profiling – the company does not make such decisions or profiling
  • the right to lodge a complaint with the manager or the supervisory authority – the supervisory authority is the Office for Personal Data Protection (www.ooou.cz);

The above-mentioned rights of data subjects are limited/modified by the exclusions in accordance with the relevant Articles of the Personal Data Protection Regulation and by the provisions of other legal regulations.

The personal data processing is further governed in detail by the Directive issued by the company. The directive is not published as it contains a complex adaptation using complex formulations.
